Акт исполнительной власти: история, дилеммы и возможные решения


Цель: анализ истории становления, развития актов исполнительной власти, а также разработка единых требований к их содержанию.


Методы: диалектический подход к познанию социальных явлений, позволяющий проанализировать их в историческом развитии и функционировании в контексте совокупности объективных и субъективных факторов, который определил выбор следующих методов исследования: формально-логический, сравнительно-правовой.


Результаты: в работе сделана попытка обобщить существующие научные положения по поводу отсутствия единых требований для актов исполнительной власти. Автор анализирует историю становления актов исполнительной власти, их сущностные признаки, надзорные институты и процессуальные механизмы, при помощи которых можно внедрить правовые требования в сферу государственного управления.


Научная новизна: в статье впервые обобщены и проанализированы различные научные подходы к требованиям для актов органов исполнительной власти, обоснована необходимость обнародования внутренних правил органов исполнительной власти в виде публичного документа.


Практическая значимость: выводы статьи могут быть использованы в научной, педагогической и правоприменительной деятельности при рассмотрении и изучении актов исполнительной власти.
